Japan Privacy Policy

Overview

 

Equinix Japan K.K., Equinix (Japan) Enterprises K.K. and Equinix (Japan) Technology Services K.K. (hereinafter, collectively, “Equinix”) hereby establishes a Policy on the Protection of Personal Information as follows with the understanding that the protection of personal information is an important theme in implementing the data center services, which is our main business, as well as other IT outsourcing related services (hereinafter, the “Equinix Services”), and familiarizes all employees with the same, and securely implements and maintains the same.

  1. Equinix shall appoint a person responsible for the protection of personal information for every organization that handles personal information (meaning “Personal Information” defined in the “Act on the Protection of Personal Information”; the same hereinafter), and shall perform appropriate management.

  2. Equinix shall obtain personal information by legitimate and fair means upon clarifying in advance the purpose of utilization and the information required by Equinix’s inquiry contact, etc.

  3. Unless the person himself/herself gives his/her consent or unless permitted by laws and regulations, Equinix shall only handle personal information to the extent required for the attainment of the purpose of utilization specified below.

  4. Equinix may delegate all or a part of the handling of personal information to a third party to the extent required for the attainment of the purpose of utilization. In such case, Equinix shall select such third party upon confirming that such third party is recognized to appropriately handle personal information, and shall implement required and appropriate monitoring towards such third party so that security management is procured for the personal information delegated.

  5. Each Equinix Group company including Equinix (including companies in foreign countries) shall share personal information obtained by each company within the Equinix Group, and uniformly manage such personal information, in order to provide better Equinix Services. For such purposes, Equinix may jointly use customers’ personal information obtained by Equinix with each Equinix Group company (including companies in foreign countries).

  6. Unless in the case set forth in the preceding paragraph or unless permitted by laws and regulations, Equinix shall not provide personal information to any third party without the consent of the person himself/herself.

  7. Equinix shall comply with the laws and regulations, policies, and other rules related to the handling of personal information set forth by Japan.

  8. Equinix shall stipulate regulations related to security management measures and handling of personal information, and shall take measures sufficient to implement appropriate handling.

  9. Equinix shall make efforts to prevent or to correct the divulgation, loss or damage to personal information handled by Equinix by taking required and appropriate security measures.

  10. Equinix shall accept complaints and consultations from the person himself/herself and take appropriate measures related to the handling of personal information.

  11. Equinix shall make efforts for continuous improvement for approaches required for the protection of personal information.

Announcements, etc. Based on the “Act on the Protection of Personal Information”

1. Purpose of Utilization of Personal Information

  1. The purposes of utilization of personal information which Equinix obtains from customers and business acquaintances

    • Provision of Equinix Services (including maintenance and support, as well as the use of data center);

    • Communications, cooperation, negotiations, performance of contracts, requests for performance, etc. with customers and business acquaintances;

    • Research and analysis for better services, support and product development;

    • Introduction to events such as seminars and exhibitions;

    • Provision of, and introduction to, etc. services and support information as well as advertisements and questionnaires, etc.;

    • Measures towards inquiries and opinions, etc. received.

  2. Purpose of utilization of personal information related to Equinix’s employment activities

    Personal information related to persons applying for employment of Equinix (hereinafter, the “Job Applicants”) shall be utilized for employment management purposes such as review for employment or rejection of the Job Applicants, review of the employment terms, measures towards inquiries, and administrative communications.

  3. Purpose of utilization of personal information of the previous shareholders of Bit-isle Equinix K.K.

    The purposes of utilization of personal information of the previous shareholders of Bit-isle Equinix K.K., which was subject to absorption-type merger by Equinix Japan K.K., are as follows.

    • Exercise of rights and performance of obligations under the Companies Act and other laws and regulations;

    • Shareholder management;

    • Grant of various benefits towards position as shareholders.

  4. Purpose of utilization of personal information of customers using Equinix’s website (hereinafter, the “Equinix Website”)

    The purposes of utilization of personal information of customers using the Equinix Website shall be as follows.

    • Future enhancement of the usability of the Equinix Website;

    • Prevention of and measures towards dishonest acts, etc.;

    • Measures towards inquiries and opinions, etc. received;

    • Customization of information indicated to customers upon the Equinix Website;

    • Sending information which customers may be interested in through electronic or other means.

* Cookie and other tracing technology

Cookie refers to the small data file which is recorded within the customer’s terminal when the customer visits the website. Cookie contains information enabling to trace the websites visited by the customer.The Equinix Website uses cookie, and information such as the internet domain name, host name, IP address, browser software, OS type, click stream pattern, and date and time may be recorded thereby. These are performed for the purposes of enhancing the convenience of the Equinix Website, and Equinix shall not share nor sell such information to any third party outside of the group. It is set so that cookie created by the Equinix Website within the customer’s terminal cannot be read by other websites.Most browsers can be set so that customers will be notified when he/she is requested to transmit cookie, and customers are able to select whether to transmit cookie, or to refuse to store or to transmit cookie. However, please acknowledge that if cookie is not transmitted, the customer shall be required to re-enter his/her ID and password when accessing specific parts of the website.

Other than the respective purposes of utilization mentioned above, in the event that Equinix enters into any individual agreement upon obtaining the personal information of the Job Applicants, the purpose of utilization shall be in accordance with the contents of such agreement.

2. Provisions Related to Joint Utilization

  1. Scope of joint users and their purposes of utilization

    Equinix may jointly utilize your personal information excluding personal information of the previous shareholders of Bit-isle Equinix K.K. with each Equinix Group company with the same purposes of utilization as those mentioned above. Upon jointly utilizing the personal information, each Equinix Group company shall organize a system compliant with the standards set forth by the Personal Information Committee Rules as standards necessary for the continuous implementation of measures equivalent to the measures required by a business operator handling personal information.

  2. Items of personal information to be jointly utilized

    The items of personal information to be jointly utilized by Equinix are: name, address, telephone number, email address, company name, department name, title, history of use of service, etc.

    2. Documents (forms), etc. required to be submitted upon making a request for disclosure, etc.

      We shall mail to you a document (a written request for the disclosure, etc. of personal information to be disclosed) prescribed by Equinix, so please fill in all the prescribed matters and mail it enclosed with the documents for the identification of the person himself/herself; provided, however, that we will only accept requests for disclosure, etc. which are sent by mail.
      When mailing the documents, we will have you inform such information as the name, address, and contact information.
      We will inform you if there are any insufficiencies or unclear points in the documents submitted; however, if you fail to respond within the prescribed term, we will send back the documents with the treatment that no request for disclosure, etc. has been made.

    3. Documents for identification of the person himself/herself or identification of an agent

       

      Upon your making a request for disclosure, we will confirm the identity of the person himself/herself or the identity of the agent with the following documents.

A. Documents for identification of the person himself/herself

If the person making the request for disclosure is the person himself/herself

One (1) each of the following 1 and 2 are required.

  1. One (1) of any of the following.

    • A copy of driver’s license;
    • A copy of passport;
    • A copy of health insurance card;
    • A copy of alien registration card;
    • A copy of basic resident register card.
  2. One (1) of any of the following.

    • A copy of resident’s card (within three (3) months after the preparation date);
    • A copy of family register or the excerpt thereof (within three (3) months after the preparation date).
  3. Precautionary matters

    • The documents are limited to those which the name and address of the person requesting the disclosure, etc. and the description of the name and address of the abovementioned copy are identical.
    • If there are any descriptions falling under sensitive personal information such as permanent address in the documents in 1 and 2 above, please black out the information described.

B. Documents for identification of the agent

In the case of an agent delegated by the person himself/herself
  1. All documents below are required.

    • One (1) copy of the power of attorney (with sign and seal of the person himself/herself);
    • Sealed power of attorney and a certificate of registered seal of such seal;
    • Documents(s) identifying the person himself/herself (A above);
    • One (1) copy of the certificate of registered seal identical to the seal of the person himself/herself pressing the seal.
  2. Precautionary matters

    • The documents are limited to those which the name and address of the person requesting the disclosure, etc. and the description of the name and address of the abovementioned person himself/herself are identical.
    • If there are any descriptions falling under sensitive personal information such as permanent address in the documents in 1 and 2 above, please black out the information described.
  1. Precautionary matters related to requests for disclosure, etc.

    1. We may not be able to respond to requests for disclosure, etc. if it falls under any of the following.

      • If the person himself/herself cannot be identified, such as in the case that the address described in the document prescribed by Equinix, the address described in the document for identification of the person himself/herself, and the registered address of the person himself/herself held by Equinix are not identical. The agency rights cannot be confirmed upon the application by the agent.

      • The agency rights cannot be confirmed upon the application by the agent.

      • There are insufficiencies or unclear points in the documents prescribed by Equinix and you fail to respond within the prescribed term.

      • The target of the request for disclosure does not fall under “Retained Personal Data.”

      • No measures need to be taken pursuant to the Act on the Protection of Personal Information.

    2. We may require time to respond depending upon the contents of the “request for disclosure, etc.”

    3. Please acknowledge in advance that, as a result of the suspension of use, deletion, erasure of “Retained Personal Data” or a request for suspension of the provision thereof to a third party, you may become unable to use the services, etc. for such personal data (personal information).
